Terms of service
These terms are an agreement between the business or person that signs up for T ("you") and Santhosh LLC, doing business as 3 Media Group, a New Jersey limited liability company, 33 Jacob Francis Way, Titusville, NJ 08560, United States ("3 Media Group", "we", "us"). The person who accepts these terms confirms that they may bind the business they sign up for.
1. What the service does
T takes the photos, videos and words you and your people send it (in the app, on the web, by WhatsApp or by text message), drafts posts from them using your own settings and automated tools, shows each draft to a person you named for approval, and publishes what that person approved to the accounts you connected. It can also hand a finished post back to you to post yourself, report on how your posts did, and suggest what to post next.
2. Your account and your people
- You decide who is an admin, who may approve and who may send. You are responsible for what they do with the service.
- Keep sign-in codes, sign-in links and review links to the person they were sent to.
- A phone number linked to your business can send content for it. Unlink a number as soon as it should no longer do so.
- When you or your people message the service's WhatsApp or text number, you agree to receive its replies about what you sent (previews, questions, confirmations and, if you ask for it, a weekly report). Message and data rates from your carrier may apply, and how many messages you receive depends on how much you send.
- Tell us at once at hello@3mediagroup.net if you believe someone else has had access.
3. Your content
- You keep every right you have in what you and your people send.
- You give us permission to store it, change its format, edit and finish it, draft from it and publish it to the accounts you connected, only to provide the service to you.
- You confirm that you have the right to post it, including the agreement of any person who can be recognised in it.
- We do not use your content to advertise our own services without your written permission.
4. Approval and publishing
- Nothing is published without an approval by a person you named, or by an automatic-approval rule you switched on yourself.
- An approval covers exactly what was shown. You are responsible for what you approve.
- You can take a post down from within the service. We cannot remove copies that others have already made or shared.
5. Automated drafting and editing
Drafts, edits, translations, voice-overs, reports and suggestions are produced by automated tools, including artificial-intelligence models run by our providers. They can be wrong. The checks the service makes reduce mistakes; they do not remove them. Read a draft before you approve it.
6. Connected accounts
You connect your Facebook, Instagram, Google, LinkedIn, X, TikTok, WhatsApp and other accounts under those companies' own terms. We act on those accounts only as far as the permissions you granted allow, and you can disconnect any of them at any time from within the service or from the other company's own settings. The service never posts, comments, likes, follows or sends messages on anyone else's content by itself.
7. Plans, trials and payment
- A trial runs for the period shown when you sign up. At its end you choose a plan or your business is paused; nothing is charged without your agreement.
- Prices, what a plan includes and what use beyond it costs are shown on the plan page before you agree to them. Payments are handled by our payment provider, Stripe; we do not see or store your full card number.
- Unless the plan page says otherwise, plans renew each period until you cancel, and you can cancel at any time with effect from the end of the period you paid for. Fees already paid are not refunded, except where the law requires it.
- Taxes that apply to the service are added where the law requires them.
8. Acceptable use
The acceptable use rules at /legal/acceptable_use are part of these terms.
9. Suspension and ending
- You may stop using the service at any time, export what it holds for you, and close your account from within it.
- We may pause publishing for a business, or close an account, that breaks these terms or puts others at risk, and we will tell you why.
- After an account is closed we delete what we hold for it as the privacy notice describes.
10. Warranties and liability
- The service is provided "as is" and "as available". To the fullest extent the law allows, we make no warranty that it will be uninterrupted or error-free, or that any post will reach a particular audience or result.
- To the fullest extent the law allows, neither party is liable to the other for indirect, incidental, special or consequential loss, or for lost profits, revenue or data, and our total liability arising out of or relating to the service is limited to the greater of the fees you paid us in the twelve months before the claim and one hundred US dollars.
- Nothing in these terms limits a liability that the law does not allow to be limited.
- You will compensate us for claims by third parties arising from content you or your people sent or approved, or from your breach of these terms.
11. Law and disputes
These terms are governed by the laws of the State of New Jersey and the federal laws of the United States that apply there, without regard to conflict-of-law rules. The state and federal courts located in New Jersey have exclusive jurisdiction over any dispute arising out of these terms, and both parties consent to that jurisdiction. Notices to us go to hello@3mediagroup.net and to the address above.
12. Other terms
If a part of these terms cannot be enforced, the rest still applies. Not enforcing a part is not a waiver of it. You may not transfer this agreement without our written agreement; we may transfer it to a company that takes over the service, and will tell you if we do. These terms, with the privacy notice and the acceptable use rules, are the whole agreement about the service.
13. Changes
When these terms change, each admin is shown the new version and asked to accept it at their next sign-in. The record of who accepted which version, and when, is kept.
